How we use your data
The information you provide is subject to EU General Data Protection Regulation. In accepting our terms of service, you consent that we may process your personal data for the purposes of arranging vehicle finance and insurance products. The word “Processing” includes obtaining, recording and holding information about you, your partner and your family finances; we obtain that information directly from you, and from third parties who you authorise to provide information. You provide information through our computer or paper application process, in your telephone conversations with us, and by letters and emails, you send us. We record this information on paper files and our computer databases. We also record electronically our telephone conversations with you. You may also provide us with copies of documents about your financial affairs which we retain. e.g. wage slips, bank statements, copies of identification, etc. We also collect information from third parties about you, in paper and computer forms. e.g. information from car dealers about the car you are purchasing, and information from credit reference agencies.
Primarily, we use your data and data about your family’s circumstances to arrange vehicle finance and insurance products on your behalf. The collection of data is necessary for us to perform our contractual responsibilities to you; i.e. the provision of the services you have requested. If you limit the information you provide to us, or decline to answer certain questions, then we may not be able to help you.
When we undertake our research, or when we arrange finance or insurance for you, we will pass some of your information to the chosen finance provider or insurance company. These companies ask for your information in the form of an application document (which could be electronic). They will ask for other supporting data relevant to your transaction and copies of your identification documents. These product providers may administer your arrangements and provide services from centres outside Europe (e.g. India, USA); these countries may not always have the same standard of Data Protection laws as the UK and EU. However, the providers of these services are required to put a contract in place to ensure that your information is adequately protected, and they will remain bound by their obligations under GDPR even when your personal information is processed outside Europe. “Processing” your data also includes transferring your data to other companies and agencies associated with us, who are part of the process. Those companies and agencies could be: (1) product providers - as explained above; (2) Credit reference agencies (see below) and lenders who provide background financial information about you; (3) the FCA, the FOS, the police, or any other statutory, governmental or regulatory body – if they request to see our files or you make a complaint; (4) solicitors and debt collection agencies – if we are involved in a dispute with you; (5) third-party suppliers who provide services to us for quality control purposes and administration. e.g. business processing services, SMS text update services, client database systems, or compliance and regulatory advice services; (6) Our account managers who work with the motor dealers (7) motor dealers who are arranging the purchase of your vehicle. You agree that relevant personal information held by ourselves may be disclosed on a confidential basis, and in accordance with regulations, to any such parties. Under the rules of the EU GDPR, we are classed as the “data controller”, and we must fulfil certain legal responsibilities to you. By sharing your data with other organisations there will be multiple “data controllers” involved in the process who must equally fulfil these responsibilities to you.
Use Of Your Personal Information by Credit Reference Agencies and Fraud Prevention Agencies
1) When you apply for finance with Prestige Car Sales Limited your details will be passed to our chosen Credit Reference Agency (CRA), Equifax Ltd (contact details below) and the following records may be created or accessed:
a) Our own
b) Those at Equifax Ltd. When Equifax receives a search request from us they will place a soft quotation footprint that will be visible to you only on your credit file. Other parties including lenders will not see this and it will not affect your credit score / rating or ability to apply for finance from other lenders.
c) We will access from Equifax Ltd both public (including the electoral register) and shared credit and fraud prevention information. This information will be used to check your eligibility against a select group of lenders.
d) We will only provide a list of lenders that you are likely to be accepted by, utilising the data returned by Equifax Ltd and our knowledge of the lenders acceptance criteria.
e) Those at fraud prevention agencies (FPAs). We will make checks such as assessing this application for credit and verifying identities to prevent and detect crime.
2) Information on applications will be sent to CRAs and will be recorded by them.
3) If you give us false or inaccurate information and we suspect or identify fraud we will record this and may also pass this information to FPAs and other organisations involved in crime and fraud prevention.
4) Your data may also be used for other purposes for which you give your specific permission or, in very limited circumstances, when required by law or where permitted under the terms of the General Data Protection Regulations 2018.

We will not contact you (or pass your details to other companies associated with us) with details of any other similar products, promotions, or for related marketing purposes.
The information you provide may also contain “special personal data.” This is defined as information about your health (or that of your family), any information related to your ethnic origin, criminal offence data, political opinions, religious or philosophical beliefs, sexual orientation, or your membership of a Trade Union. e.g. During our telephone conversations, you may tell us about your state of health.
We will retain your data for the purposes of providing our services, and for future administration. We will also retain your data according to the statutory requirements for regulated products. This will be held for the duration of any credit agreement. If you want details of the statutory retention periods for various products, please contact us and we will obtain the latest legal position on your behalf. If you wish us or any company associated with us to cease processing your personal data or special personal data, please contact The Data Protection Officer at our office address.
Steps will be taken to ensure that the information we hold is accurate, kept up to date and not kept for longer than is necessary. We will correct any information when you tell us that we hold inaccurate data. Measures will also be taken to safeguard against unauthorised or unlawful processing and accidental loss, destruction or damage to the data. Subject to certain exceptions, you are entitled to have access to your personal data held by us, and this will normally be free of charge. You would only be charged a fee to provide further copies of the same information already provided, or if your request is unfounded, excessive or repetitive. What will you have to pay us for our services?
We do not charge a fee for the introduction to the finance provider; however, where we source the vehicle, we may charge a Broker Service Fee.
Commission Disclosure
We will receive a commission payment from the finance provider if you decide to enter into an agreement with them. The amount of commission can be made available to you upon request in writing.
Suitability and Affordability
We aim to support and tailor our service appropriately to those customers who may be particularly vulnerable due to their current circumstances or recent life events. If you have a disability, physical or mental health condition, feel vulnerable due to a change in personal circumstances, or just need extra support please let us know and we will do our best to help you. You should make sure you have sufficient time and support to assess the information given to you and ensure the funding option offered is suitable for you and meets your requirements.
